Through the present writ petition, the Petitioner prays as under : "(i) Direct the respondents to consider to case of the petitioner for waive of/reduction of the amount of Rs.51,86,922/- as claimed by the respondents vide order dated 05/12/2024 under the provisions of Rule-63 of CCS(Leave) Rules, 1972. OR In alternative (ii) Direct the respondents to adjust the above amount from the pending NPS/GPF amount of petitioner with the respondents and accept the Resignation of the petitioner from service and consequently the petitioner may be relieved from service. (iii) Issue a writ of Mandamus/orders/directions as may be deemed just and proper in the facts and circumstances of the case. (iv) Award cost;"

The petitioner was selected for the post of Assistant Commandant/Medical Officer in the ITBP and joined services on 26.04.2012 and was promoted to the post of Senior Medical Officer The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It emerges that the Petitioner herein has completed his postgraduation course. He was granted admission as an in-service candidate and had availed paid study leave. A bond of Rs. 33,91,200/- was executed by the Petitioner, while proceedings on study leave, to serve the institution for a period of three years after completing the course.

Subsequently, the Petitioner submitted his resignation, which was not accepted as the Petitioner was required to pay the bond amount along with interest.

Now, the Petitioner has approached this Court essentially seeking waiver of the above amount or in the alternative, acceptance of his Resignation from service.

On the very first date of hearing, the following order was passed:

"1.

After hearing learned Counsel for the parties, we are not inclined to entertain prayer 'i' in this writ petition. 2.

However, apropos prayer 'ii', Ms. Avshreya Pratap Singh Rudy, learned CGSC seeks a day's time to take instructions. 3.

Re-notify on 23 December 2025 in the Supplementary List."

Upon realising that the Petitioner cannot be granted even relief sought under Prayer (ii) as well, the learned counsel representing the Petitioner submits that the Petitioner is undertaking to pay the bond amount along with interest within a period of next six weeks. 8.
