% 03.05.2017 This is an application under Section 439 Cr.P.C. filed on behalf of the petitioner for grant of interim bail in case FIR No.225/2013, under Sections 302/323/34 IPC, Police Station-S.P. Badli, Delhi. Counsel for the petitioner has submitted that the petitioner has to undergo surgery for kidney stone on 09.06.2017 and prays that the petitioner be granted interim bail for two weeks.
Learned APP for State opposes the bail application. As per the report of Medical Officer, In-Charge, Central Jail No. 04, Tihar, New Delhi dated 19.03.2017, the petitioner has to undergo surgery for left side kidney stone on 09.06.2017.
Keeping in view the submissions made by learned counsel for the petitioner and in view of the report of Medical Officer, In-Charge, Central Jail No. 04, Tihar, New Delhi, the petitioner is granted interim bail for a period of fifteen days effective from the date of his release i.e. from 8th June,
2017 on the following conditions:- (i) The petitioner shall furnish personal bond in the sum of Rs.25,000/- with two sureties in the like amount to the satisfaction of the Trial Court concerned.
(ii) He is also directed not to contact, threaten or coerce the victim or any of his/her family members during this period or to indulge in any illegal activities.
(iii) He is also directed to furnish his contact number to the SHO concerned.
(iv) He is to surrender before the Superintendent Jail after the expiry of period of interim bail.
Petitioner be informed through the Superintendent Jail. Copy of the order be also sent to SHO, Police Station- S.P. Badli, Delhi, to the concerned Trial Court and to the concerned Jail Superintendent for information.
Petition stands disposed of accordingly.
