The present writ petition has been filed seeking directions to the respondent-Municipal Corporation of Delhi ("MCD"), for not obstructing and interfering in the repair work of boundary wall, including, raising the height of the same, within permissible height limit as per law, around the land comprising in Khasra No. 543 (5-08), total admeasuring 5 bighas 8 biswas, situated in the Village Hiranki, Delhi, owned by the petitioner. 2.
Issue notice. Notice is accepted by learned counsel appearing for respondent-MCD, who submits that the petitioner has neither started the construction work of the wall, nor has the MCD ever gone at the site for obstructing the construction of the boundary wall of the property. 3.

further submits that there is a private dispute between the petitioner and the seller of the land in question.

He, thus, submits that in the garb of the present petition, the petitioner may not try to establish his ownership over the land in question. 5.
Having heard learned counsels for the parties, it is clarified that this Court in a writ petition would not adjudicate on the issue, as regards the title, possession and ownership of the property in question. 6.
Needless to state, any lawful owner/occupier of a property is entitled to construct a boundary wall around their property in terms of the Building Bye-laws and permissible height as allowed therein. 7.
Noting the aforesaid, the present writ petition, along with the pending application, is disposed of.
