Various communications of the Sub-Registrar are under challenge in these writ petitions. They essentially relate to the objection raised by the petitioner for non-registration of a document which has been presented by a third party. The petitioner has various submissions to make as to why the document should not be registered.

The Sub-Registrar intimated that in the absence of there being any order by the competent court, he could not withhold the registration of the document which otherwise is required to be registered under the provisions of the Registration Act, 1908 ['Act'].

It be noted that the Registrar exercises the power of superintendence over the Sub-Registrar. Section 68 of the Act provides the aforesaid mechanism.

Be that as it may, since the nature of the dispute which essentially relates to the property and the claim over the same, between two individuals, the parties would be well advised to avail the necessary remedy in accordance with law.

At this stage, Mr. Malak Bhatt, learned counsel appearing for the petitioner, seeks liberty to withdraw the instant petition with liberty to take appropriate recourse in accordance with law.
