This petition is directed against the advertisement dated 15th November, 2025, and seeks a declaration that Clause 9(ii) and Clause 11 thereof are ultra vires and unenforceable, being contrary to the notified Recruitment Rules dated 8th May, 2012.

During the pendency of the present proceedings, Mr. Ali Ahmed Khan, the Petitioner appearing in person, submits that the Council for Leather Exports has issued a fresh advertisement dated 16th April, 2026. In view thereof, he seeks leave to withdraw the present petition with liberty to challenge the said subsequent advertisement.

Mr. Khan further submits that the fresh advertisement suffers from the same legal infirmities as urged in this petition. He states that he has already submitted a representation today and if the Respondents consider and accept The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the same on or before 6th May, 2026, the necessity of approaching this Court may not arise.

At this stage, it is also noted that the Council for Leather Exports has raised an objection to the maintainability of the present petition on the ground that it is not an instrumentality of the 'State' within the meaning of Article 12 of the Constitution of India.

Be that as it may, since the Petitioner seeks leave to withdraw the present petition, the said request is allowed. 6.

Leave and liberty, as prayed for, are granted. 7.

Keeping the objection of the Respondents on maintainability open, this Court is of the opinion that if the Petitioner's grievance can be addressed pursuant to the representation submitted by him, it may obviate the need for further litigation. Accordingly, the Respondents are directed to consider and decide the Petitioner's representation submitted today on or before 6th May, 2026. In the event the Petitioner remains aggrieved, he shall be at liberty to take appropriate steps in accordance with law, including challenging the advertisement dated 16th April, 2026. 8.

All rights and contentions of the parties are left open. 9.

The petition, along with pending applications, stands disposed of in the above terms.
