The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C), now Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), seeking issuance of a writ in the nature of Habeas Corpus, directing the respondent nos. 1 to 5 to produce the minor daughter of the petitioner, namely Ms. xxxx, before this Court.

It is alleged that the daughter of the petitioner went missing from her house on 05.10.2025 and on inquiring from the respondent no.8, the petitioner was informed that she has been taken to Bengal The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. This Court, vide Order dated 19.12.2025, while issuing notice in the present petition, directed the respondent nos. 2 to 5 to produce the minor Ms. xxx before this Court on the next date of hearing. 4.

Mr. Sanjay Lao, the learned Standing Counsel for the State, submits that the minor girl has since been recovered. 5.

The minor girl, Ms.xxx, is physically present in the Court. 6.

We have interacted with the minor girl, Ms.xxx. She states that she does not wish to go into the custody of her parents, as she alleges that her parents often beat her.

Mr. Lao, the learned Standing Counsel for respondent nos. 1 to 5, submits that the minor girl had gone missing from her family on three separate occasions. He further submits that she was produced before the learned Principal Magistrate, Juvenile Justice Board-II, Delhi Gate, New Delhi, on 05.01.2026, and that the learned Principal Magistrate directed that the minor girl, Ms. xxx, be produced before the concerned Child Welfare Committee for care and protection and for providing counselling on the same day.

Since the girl does not want to go into the custody of her parents, the petition is disposed of with a direction that the minor girl, Ms. xxx, be produced before the Child Welfare Committee today itself for further directions.
