Despite directions issued by this Court, the Petitioner has failed to get himself admitted to the Institute of Human Behaviour and Allied Sciences (IHBAS) for a comprehensive assessment. When confronted with this fact, counsel for the petitioner chose to abandon the plea regarding the petitioner's mental capacity.

In view of the above circumstances, the stay granted by this Court on 31st January, 2025, which was based on the petitioner's claim of mental illness and ongoing treatment, is no longer sustainable and, accordingly, stands vacated.

on the Petitioner's alleged plea of insanity and behavioural changes, is, in the opinion of this Court, not maintainable. Accordingly, the petition is dismissed.

It is clarified that if the petitioner chooses to challenge the FIR on other grounds, such a petition shall be considered on its own merits. This Court has not expressed any opinion on the maintainability of such a petition.
