% 10.10.2018 Crl.M.A. 34117/2018 (early hearing) For the reasons stated in the application, the same is allowed. Application stands disposed of accordingly.
CRL.M.C. 4425/2018 & Crl.M.A. 31106/2018 FIR No. 08/2014 under Sections 498-A/406/34 IPC was registered at Police Station - Rajouri Garden, Delhi on the complainant of respondent No. 2 - Ms. Mini.
Respondent No.2- Ms. Mini is not present in Court. Her father, namely, Mr. Satish Kumar Tandon is present in Court. He also holds a Special Power of Attorney in his favour duly executed by respondent No. 2
- Ms. Mini. Special Power of Attorney has been taken on record. Mr. Satish Kumar Tandon submits that the matter has been settled between the petitioners and respondent No. 2, voluntarily and without any undue force, pressure or coercion. Mr. Satish Kumar Tandon also submits that the marriage between petitioner No. 1 and respondent No. 2 has already been dissolved by a decree of divorce by mutual consent dated 13.07.2016. Certified copy of the divorce decree has been placed on record. Petitioner has handed over a demand draft of Rs.75,000/- drawn in favour of Ms. Mini Tandon to Mr. Satish Kumar Tandon. Mr. Satish Kumar Tandon states that he has instructions from respondent No. 2 to convey to the Court that she has no objection in case FIR No.
08/2014 under Sections 498-A/406/34 IPC registered at Police Station - Rajouri Garden, Delhi and the consequent proceedings emanating therefrom are quashed against the petitioner. Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, I am of the view that no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed against petitioner No. 1 and his relatives i.e.
petitioner Nos. 2 and 3.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
The next date of hearing fixed in the matter stands cancelled. A.K. PATHAK, J OCTOBER 10, 2018 PB
