% 20.04.2018 After some arguments, learned counsel for the petitioner concedes that since he has not availed the alternate remedy of statutory appeal provided under Section 18 of the NCTE Act, he may be granted leave to withdraw the present petition with liberty to file an appeal before respondent No.1. He however, prays that the respondents may be directed to decide the appeal in an expeditious manner.

Mr.Rohit, Advocate, who appears on advance notice for the respondents, submits that in case the requisite appeal is filed by the petitioner within a period of one week, the same would be considered by the respondents on merits.

The petition is disposed of with a direction to the respondents that, in case, the requisite appeal is filed by the petitioner within a period of one week, the same would be considered on its own merits by passing a reasoned and speaking order and would not be rejected on the ground of delay, if any.

It is clarified that it will be open for the petitioner to take all available grounds in the appeal including the grounds urged in the petition.

Needless to say that in case the petitioner is still aggrieved, it will be open for the petitioner to take legal recourse as permissible under law.
