The present application under Order XXXII Rule 3 of the Code of Civil Procedure, 1908, has been jointly filed by the parties for recording of compromise and passing of decree in terms of the Settlement Agreement dated 02.09.2025.

The instant Suit is for a decree of partition of a property bearing no. 106, Defence Enclave, Vikas Marg, Shakarpur, East Delhi, Delhi - 110092. 3.

During the pendency of the Suit, the parties were referred to mediation, where parties have settled their disputes vide a Settlement Agreement dated 26.09.2025. The Settlement Agreement dated 26.09.2025 reads as under:

Pending applications, if any, also stand disposed of. 7.

Let the Decree Sheet be prepared accordingly. 8.

The parties shall be bound by the terms of the Settlement Agreement dated 26.09.2025.

Since the parties have settled the matter, the Plaintiff shall be entitled to the refund of Court Fees in terms of Section 60 of the Court Fees Act, 1870.
