Through the present petition, the petitioner seeks interim bail for a period of six weeks in FIR No. 383/2016 registered at Police Station Jyoti Nagar for the offences punishable under Sections 302/120B/34 of the Indian Penal Code, 1860 (hereinafter "IPC").

Learned counsel for the petitioner advanced the argument on the point the he needs to safeguard the education of his two minor sons, Sahil and Salman. It is submitted that both children are presently studying at Sant Suraj Muni Junior High School, Hapur, Uttar Pradesh, and the school authorities have issued written notices recording that the school fees are in arrears, that the children are unable to concentrate on their studies, and that adverse action may be taken in accordance with school rules if the dues are not cleared, thereby placing their continued education in serious jeopardy. Learned APP for the State has opposed the present application and submits that the trial in the matter is at a fag end. It is contended that, at this advanced stage of the trial, no case is made out for grant of interim bail on the grounds urged by the petitioner.

Having heard learned counsel for the petitioner, this Court is of the view that the allegations in the present case are grave in nature, involving offences under Sections 302/120B/34 of the IPC and the trial is at an advanced stage. Accordingly, this Court does not find any cogent reason to allow the present petition 5.

Accordingly, the present petition along with pending applications, if any, stands dismissed.
