Mr. Rahul Malhotra, learned counsel appearing on behalf of the plaintiff seeks to withdraw the present suit with liberty to file afresh. 2.

The suit is dismissed as withdrawn with liberty as aforesaid. 3.

Mr. Malhotra prays for refund of the Court Fee. 4.

Since the suit had not been registered, the Registry is directed to issue certificate with regard to the refund of court fee to the plaintiff. 5.

Pending applications stand disposed of.
