This writ petition is filed on behalf of the Petitioners under Article 226 of the Constitution of India seeking the following reliefs:- "a) issue a writ of mandamus or any other suitable writ, order or direction to respondent to activate payment tab of petitioner institute enabling it to make re-payment of processing fee for extension of approval of its existing D.Pharm course & for approval of B.Pharm course for academic session 2026-27; and/or b) issue a writ of mandamus or any other suitable writ, order or direction to respondent to refund the processing fee of Rs. 7,08,000/- (Rs. Seven Lakhs Eight Thousand Only) including 18% GST paid by petitioners towards application (SIF) of. B.Pharm course for academic session 202526." 2.

After canvassing some arguments, Mr. Amitesh Kumar, learned counsel for the Petitioners, on instructions, submits that insofar as prayer (a) is concerned, Petitioners do not press the same and liberty be granted to take W.P.(C) 19385/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. recourse to appropriate remedies before the appropriate forum, in accordance with law. Insofar as prayer (b) is concerned, it is urged that Respondent is liable to refund the processing fee of Rs. 7,08,000/- including 18% GST paid by the Petitioners towards SIF of B. Pharm Course for academic session 2025-26 and therefore, a direction be issued to the Respondent to consider the case of the Petitioners for refunding the amount. 3.

Issue notice.

Mr. Ajay Kumar Singh, learned counsel accepts notice on behalf of the Respondent.

Without going into the merits of the case, writ petition is disposed of directing the Respondent to consider the case of the Petitioner for refund of Rs. 7,08,000/- including 18% GST paid by the Petitioners towards their application for B.Pharm Course for academic session 2025-2026, in accordance with law. Decision will be taken by the Respondent within four weeks from today. Reasoned and speaking order will be passed and communicated to the Petitioner within one week from the date of decision. Needless to state Petitioners will be at liberty to take recourse to appropriate legal remedies in case of any surviving or further grievance. Insofar as prayer (a) is concerned, it is left open to the Petitioners to take recourse to appropriate remedy before the appropriate forum.
