The present writ petition has been filed seeking directions to the respondent nos. 1 and 2, to take action against the illegal and unauthorized construction being raised by respondent nos. 3 to 5 in the property bearing No. WZ-65/3, in Khasra No. 1671/2, approximately 2350 Sq. yards, situated within the Abadi Deh of Village Naraina, Tehsil Delhi Cantt., New Delhi110028. 2.

Learned counsel for the petitioner submits that the petitioner is one of the joint-owners in the subject property, with land measuring 2 bighas and 7 biswas falling in Khasra No. 1671/2 approx. 2350 sq. yards, situated within the abadi deh of Village Naraina, Tehsil Delhi Cantt., New Delhi. 3.

It is submitted that in the said joint family property, the petitioner and his siblings have 1/6th share.

respondent-Municipal Corporation of Delhi ("MCD") submits that the property has already been booked for unauthorized construction on 16th December, 2025 and that requisite action shall be taken, in accordance with law.

Considering the submissions made before this Court, it is directed that the MCD shall take action after following the due procedure and in accordance with law, in case of unauthorized construction being carried out in the property in question.

Any further unauthorized construction being carried out in the property shall be stopped forthwith.

Rights and contentions of the parties are left open. In case any party is aggrieved by any action or non-action on the part of the MCD, their right to seek remedies in accordance with law, is reserved. 8.

The MCD is enjoined to take time bound action against the unauthorized construction being carried out.

Additionally, in case the petitioner is aggrieved that requisite action is not being taken against the unauthorized construction, or further unauthorized construction is taking place in the property in question, the petitioner is granted liberty to revive the present writ petition. 10.

With the aforesaid directions, the present writ petition, along with pending application, is accordingly, disposed of.
