% 20.04.2018 C.M. Appl. No. 15378/2018 (for exemption) 1.

Exemption allowed, subject to all just exceptions. C.M. stands disposed of.

RFA 328/2018 and C.M. Appl. No. 15377/2018 (for stay) 2.

The matter was argued on behalf of the appellant. After arguments, a pass-over was granted to the counsel for the appellant to take instructions. Counsel for the appellant says that he has taken instructions from the appellant and though the appeal be disposed of as not pressed, but since the appellant is a widow, the appellant be granted sufficient time to vacate the suit premises.

A period of two years as prayed for is granted to the appellant to vacate the suit premises and therefore appellant will not be evicted from the suit premises till 30.4.2020. The appellant will, however, clear all charges RFA 328/2018

payable towards electricity, water, etc. with respect to the suit property in her possession.

Let the appellant file an affidavit of undertaking in this Court in terms of the present order within two weeks from today, and on the appellant filing the undertaking and complying with the terms of the same, the appellant will not be evicted from the suit property till 30.4.2020. Dasti.
