O R D E R

The present revision petition has been filed by the petitioner praying for setting aside of condition of pre-deposit of Rs.10,00,000/- for suspension of sentence mentioned in the order dated 09.12.2025 whereby the sentence of the petitioner was suspended.

Mr. Amit Yadav, learned counsel appearing on behalf of the petitioner submits that while suspending the sentence of the petitioner till 07.02.2026, the petitioner has been separately directed to pay the fine of Rs.10,00,000/- on or before 22.12.2025.

He further contends that apart from assailing his conviction, the petitioner shall also be assailing the sentence which includes the fine of Rs.10,00,000/-.

petitioner to deposit the fine amounting to Rs.10,00,000/- on or before 22.12.2025, it is in a way a pre-condition for preferring an appeal, which is contrary to the law.

This Court finds favour with the submission of Mr. Yadav that in view of suspension of sentence of the petitioner till 07.02.2026 on furnishing a bail bond, further direction to deposit the amount of fine of Rs.10,00,000/- on or before 22.12.2025, was unwarranted. Likewise, the observation that the bail bonds on behalf of the petitioner are accepted till 22.12.2025, is also unsustainable, when the sentence itself has been suspended till 07.02.2026. 6.

Accordingly, the said directions are set aside. 7.

It is clarified that the sentence of petitioner shall remain suspended till 07.02.2026 and the bail bonds shall also be valid till the said date. 8.

The petition along with pending applications stands disposed of in the above terms.

The petitioner may avail his remedy of appeal against the judgment of conviction and order of sentence, in accordance with law.
