On 11th September, 2013 while disposing of IA No.19809/2012 in CS(OS) 1385/2007, this Court in the concluding paragraph has passed the following order:- "I appoint Mr.Vinod Kumar Bansal, Director of the plaintiff company as the receiver and he is authorised to take steps to terminate the monthly tenancy, if any, of Mr.R.N.Singh and to take steps for his eviction in accordance with law. CM(M) 326/2017

The receiver shall, however, file an undertaking not to deal with the suit property except with the leave of the Court. Application stands disposed of."

Learned senior counsel for the petitioner on instruction submits that in view of the direction given by this Court vide order dated 11th September, 2013 while disposing of IA No.19809/2012 in CS(OS) 1385/2007, she may be permitted to withdraw this petition.

Learned senior counsel for the petitioner further informs that pursuant to the direction the suit for possession has already been filed by the Receiver against the petitioner and is being defended by him. 4.

The petition is dismissed as withdrawn.
