The petitioner has filed the instant petition for the following reliefs: "(a) Pass a writ of certiorari or any other appropriate writ, order or direction thereby quashing and setting aside the Letter dated 16.07.2024 bearing No. SR-I/KG/DM/2024/765 issued by the Respondent No. 3; (b) Pass a writ of mandamus or any other appropriate writ, order or direction thereby directing the Respondent No. 3 to forthwith register and release the sale deed dated 10.07.2024 presented by the Petitioner for registration"

The sale deed is not being registered on the ground that the same is included in the list of Waqf properties.

Learned counsel appearing for the petitioner points out from varies documents that the aforesaid presumption of the Registrar is bereft of any merit and has no substance. application, that the property is not in the list of Waqf properties. 4.
In view of the aforesaid circumstances, the Court disposes of the instant petition with the following directions: i.
Let the Sub-Registrar to look into the documents being placed on record by the petitioner and if necessary, to get in touch with respondent No.4 in order to verify whether the property belongs to Waqf.
ii.
If there is no impediment, let the registrar to take appropriate steps for registration of the property. If, for any reason, the registrar is unable to register the document, let a speaking order be passed within a period of two months from the date of receipt of the order passed today.

The petitioner, thereafter, shall be at liberty to take recourse in accordance with law.
