The petitioner seeks quashing of FIR No.100/2009 under Sections 420/468/471/193 IPC, Police Station Economic Offences Wing.

It is contended that the parties are related to each other. Petitioner and respondent No.2 are real brothers. The subject FIR emanates out of a family dispute.

Learned counsel for the petitioners submits that both the parties have settled their disputes and a settlement deed dated 20.02.2018 has been executed between the parties.

The parties have settled their disputes not only in respect of the said FIR but also with other family members including the disputes with regard to their ancestral properties.

The respondent No.2 is present in person and is identified by Crl.M.C1867/2018

the Investigating Officer. He submits that he has settled all the disputes with the petitioner.. He further submits that he does not wish to press his complaints.

In view of the fact that disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.

In view of the above, the petition is allowed. FIR No.100/2009 under Sections 420/468/471/193 IPC, Police Station Economic Offences Wing and the consequent proceedings emanating there from are accordingly quashed.
