Issue notice to the respondents. Mr. Sarat Chandra accepts notice on behalf of respondent no.1.

2.1 Mr. Chandra, who appears on advance notice, informs me that he has instructions to the effect that respondent no.2 has withdrawn himself from the arbitration.

2.2 Mr. Chandra says that therefore, the petition has been rendered infructuous. Furthermore, learned counsel submits that a new Arbitrator would be appointed bearing in mind the provisions of the Arbitration and

Conciliation Act, 1996.

Learned counsel for the petitioner having heard the statement made on behalf of respondent no.1, does not wish to press the captioned writ petition any further.

The petition is disposed of based on the statement made on behalf of respondent no.1.
