Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') read with Article 227 of the Constitution of India, has been filed on behalf of the Petitioner, for quashing of FIR No. 202/2019 dated 10.04.2019 under Section 498A and 406 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') read with Section 34 of IPC registered at Police Station Jahangir Puri and all the consequential proceedings emanating therefrom.

On advance Notice, learned APP has appeared and accepted the Notice on behalf of the State.

Brief facts of the case are that the marriage was solemnized between Petitioner/husband and the Respondent No. 2/wife on 27.11.2015, according to the Hindu rituals and two children i.e. one daughter, namely, Hanshi and one son, namely, Shoriya Srivastav, were born on 22.10.2016 and 10.07.2018 respectively.

On the Complaint of the Respondent No.2/Complainant, FIR No.202/2019 dated 10.04.2019 under Section 498A and 406 of IPC read with Section 34 of IPC, got registered at Police Station Jahangir Puri. 8.

It is submitted that the FIR was a consequence of the matrimonial disputes between the Complainant and the Petitioner. It is stated that the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them. An Affidavit dated 17.12.2025 has been filed on behalf of the Respondent No. 2, in this regard. It is submitted that the parties have been residing together since 2019 along with both the minor children. It is also settled between the parties that they do not wish to litigate any further and want to lead a peaceful married life. 9.

The Respondent No. 2/wife states that she has no objection if the FIR is quashed.

Both the parties are present through Video-Conferencing and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily, without any fear and coercion and undertake to remain bound by the terms of the Affidavit dated 17.12.2025 filed on behalf of the Respondent No. 2. Considering the nature of the allegations and that they have settled the matter, the FIR No. 202/2019 dated 10.04.2019 under Section 498A and 406 of IPC read with Section 34 of IPC registered at Police Station Jahangir Puri and all the consequential proceedings emanating therefrom are quashed. 12.

The Petition is disposed of accordingly.
