The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, seeking production of Mr.Mohd.Aziz, who is stated to be missing since 29.08.2025.

In the petition, it is alleged that the petitioner apprehends that the respondent nos.5 and 6 may have a role to play in the disappearance of Mr.Mohd. Aziz as they had threatened the tenants of the petitioner, residing at Darbanga, Bihar, using the following words: "JAISE HAMNE MOHD. Pursuant to the notice issued of this petition, the learned Standing Counsel has filed the Status Reports dated 26.02.2026 and 19.04.2026, detailing the enquiries made to ascertain the whereabouts of Mr.Mohd Aziz, including from the respondent nos.5 and 6. He submits that in these enquiries nothing concrete could be found to establish any role played by the respondent nos.5 and 6 in the disappearance of Mr.Mohd.Aziz. He submits that further efforts shall be made to ascertain the whereabouts of Mr.Mohd. Aziz. 4.

Keeping in view the above, we dispose of this petition by directing the respondents to file further Status Reports, on a quarterly basis, on the efforts made to trace out Mr.Mohd.Aziz, before the concerned Magistrate, and to abide by further directions issued by the learned Magistrate in this regard. In this process, if the petitioner wishes to participate, he shall be allowed to do so. 5.
