Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for quashing of Summoning Order dated 15.09.2023 and Complaint bearing CC NI Act 18165/2023 under Section 138 NI Act, which is pending before the Court of learned MM, NI Act Digital Court 01, Dwarka Courts, Delhi.

Essentially, ground of challenge, submitted in the Petition, is that there is no legally recoverable debt, which is prima facie made out. It is claimed that subject suit property has already been sold by the Complainant without prior Notice to the Petitioner. The Complaint is mala fide. 3.

Quashing of Summoning Order dated 15.09.2023 has been sought on merits. The alternate efficacious remedy was to approach the learned Sessions Court.
