This petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (corresponding to Section 482 of the Code of Criminal Procedure, 19732) seeks a direction to the concerned Family Court to expeditiously decide the Petitioner's interim application in Maintenance Petition No. 158/2022, titled Anuradha v. Rahul Sharma, within a period of two weeks.

The Petitioner and the Respondent were married on 30th January, 2015. Owing to matrimonial differences, the parties have been living separately since December 2019. The Petitioner has instituted proceedings under Section 125 CrPC seeking maintenance alleging that she is without any financial support. The said petition remains pending, and the Petitioner's application for interim maintenance has also not been 1 "BNSS"

adjudicated, constraining her to approach this Court seeking expeditious disposal of the interim application.

Before issuing any directions, it must be emphasised that this Court is not apprised of the overall pendency before the concerned Bench, nor is it aware whether the Petitioner's case warrants exceptional prioritisation. It is possible that matters older than the Petitioner's case are also pending consideration, thus, prioritisation of cases lies within the discretion of the concerned Judge.

However, considering that the Petitioner's interim application has been pending since the year 2022, the Trial Court is requested to consider the Petitioner's case upon her filing an appropriate application seeking early hearing. It is noted that the Petitioner's earlier application for early hearing was dismissed. In the event a fresh application discloses justifiable grounds for expeditious consideration, the Trial Court shall pass appropriate orders in accordance with law.

With the above directions, the present petition is disposed of along with the pending application.
