Allowed, subject to all just exceptions. This application is disposed of. CONT.CAS(C) 1942/2025 3.

The present petition under Article 215 of the Constitution of India, 1950 read with Section 12 of the Contempt of Courts Act, 1971 seeks the following prayers: - "a) Initiate Contempt Proceedings against the Contemnor/Respondent for willful disobedience and violation of the order dated 03.09.2025 in Writ Petition (C) No. 13431 of 2025 passed by this Hon'ble Court; and b) Pass such further or other Order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case." 4.

Vide order dated 03.09.2025 passed in W.P.(C) 13431/2025, learned Single Judge of this Court passed the following directions: - "7. directed that the vehicle of the petitioner, as aforesaid, shall be released by the scrapper forthwith.

8. As regards the payment of charges to the MCD, considering the submissions made before this Court, it is directed that the petitioner shall make a payment of Rs. 1000/- as charges payable for release of the vehicle.

9. It is clarified that the present order has been passed in the peculiar facts and circumstances of the present case." 5.

Learned counsel appearing on behalf of the MCD, on advance notice, submits that the validity of the Demand Draft of Rs. 1,000/- which was deposited by the petitioner has since lapsed, the petitioner may submit a fresh Demand Draft and the subject vehicle will be released within a period of 3 working days therefrom. It is further submitted that the vehicle is with the scrapper.

In view of the above, the present petition is disposed of with the directions to the MCD, on petitioner depositing a fresh Demand Draft of Rs. 1,000/-, the subject vehicle shall be released within a period of 3 working days.

The present petition is disposed of with the aforesaid directions. 8.

Pending application(s), if any, also stand disposed of. 9.

In case of non-compliance, the petitioner will be at a liberty to revive the present petition.
