By way of the present petition, the petitioner seeks quashing of FIR bearing no. 69/2018, registered at Police Station Mayur Vihar Phase-I, District East Delhi, for the commission of offence punishable under Sections 363/366/376(2)(n) of Indian Penal Code, 1860 (hereafter 'IPC') and Section 6/5(I) of the Protection of Children from Sexual Offences Act, 2012 (hereafter 'POCSO Act') and the proceedings emanating therefrom. Issue notice. The learned APP accepts notice on behalf of the State. 5.

The petitioner and respondent nos. 2 and 3 are present before this Court and have been identified by their counsels and concerned Investigating Officer (IO) from Police Station Mayur Vihar Phase-I, District East Delhi.

Brief facts of the present case are that the on the complaint of respondent no. 3 i.e. the mother of respondent no. 2, the present FIR was registered against the petitioner under relevant sections of law. Thereafter, the petitioner was arrested and investigation commenced. It is stated that on 08.03.2018, the statement of respondent no. 2 was recorded under Section 164 of Cr.P.C. wherein she admitted her relationship with the petitioner and stated that she had married him of her own free will. Further, it is stated that on 12.06.2019, upon attaining majority, the respondent no. 2 solemnized marriage with the petitioner, and on 13.07.2021, they were blessed with a son namely Lakshya out of the wedlock.

On a query made by this Court, respondent nos. 2 and 3 who have been identified by the IO, have categorically stated that they have entered into compromise out of their own free will and without any pressure, coercion or threat. Respondent nos. 2 and 3 further states they have no objection if the present FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. Accordingly, FIR bearing no. 69/2018, registered at Police Station Mayur Vihar Phase-I, District East Delhi, for the commission of offence punishable under Sections 363/366/376(2)(n) of IPC and Section 6/5(I) of the POCSO Act and all consequential proceedings emanating therefrom are quashed.
