The present writ petition has been filed, inter alia, seeking directions to the respondent to grant a new commercial electricity connection with 1 KW sanction load in respect of the Flat bearing No. B-16, Basement, Ansal Chamber-II, Bhikaji Cama Palace, New Delhi-110066 (hereinafter the 'subject premises').

It is submitted on behalf of the petitioner that the petitioner is a senior citizen lady, being 50% owner and occupier of the premises in question. The petitioner claims ownership and occupation of the said premises on the basis of an Agreement to Sell dated 31st December, 1996 in her favour (Annexure P-4 to the writ petition). It is further submitted that the erstwhile tenant was evicted through legal process, by way of an eviction decree passed by a Court of law. 4.

Thereafter, the petitioner filed an application for installation of a new electricity connection for the said flat. However, despite multiple reminders as well as visits to the office of the respondent/BSES Rajdhani Power Limited (hereinafter 'BRPL') on various occasions, the needful has not been done.

Counter affidavit has been filed on behalf of the respondent/BRPL wherein it is stated that the application of the petitioner for a new electricity connection was auto-cancelled due to the petitioner not appearing at the designated service centre on the scheduled date of appointment and/or due to non-submission of ownership occupancy documents. 6.

Counsel for the petitioner submits that earlier there was an electricity connection at the subject premises which was disconnected due to nonpayment of electricity bills by the tenant. 7.

In light of the aforesaid, it is apparent that the petitioner has been in legal occupation of the said premises from 31st December, 1996 and therefore, the petitioner would be entitled to grant of electricity connection. 8.

Accordingly, the present writ petition is disposed of while directing the petitioner to apply for a fresh electricity connection along with relevant documents showing the occupation of the petitioner of the subject premises. 9.

Upon filing of the said application, the respondent/BRPL shall forthwith process the application in accordance with applicable rules and regulations without insisting on ownership documents. 10.
