Status report has been filed on behalf of the respondent no.1/ MCD. In the status report, it is stated as under:

(i) In the inspection carried out by MCD, it was found that the owner/ occupier had carried out unauthorized construction in the shape of part fourth floor (mumty) over existing construction of Ground Floor to Third Floor at property bearing No. 2/67, Nehru Nagar, New Delhi-110065 (hereinafter the 'subject property').

(ii) A show cause notice was issued on 11th July, 2025. (iii) After following due process of law, demolition order under Section 343 of the Delhi Municipal Corporation Act, 1957 (hereinafter 'DMC Act') was passed on 4th August, 2025. (iv) A work stop notice was also issued on 21st July, 2025. (v) Pursuant to the demolition order, the demolition action against the subject property took place on 5th January, 2026.

Photographs of the demolished portion of the property has been filed along with the status report.

(vi) On 7th January, 2026, a letter had been issued to SHO, P.S. Lajpat Nagar, with the request to keep strict vigil over the property so that the owner does not restore the demolished portion.

Additional photographs on behalf of the respondent no.1/ MCD have been handed over in Court today which show that 1 RCC panel at the roof of fourth floor (mumty) of the subject property continues to remain demolished.

The same are permitted to be taken on record. 3.

Taking into account the aforesaid submissions, the present writ petition is disposed of, as the reliefs sought in the present writ petition stand satisfied.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

All rights, contentions and legal remedies of the owner/occupier shall remain protected.
