Crl.M.A No.14772/2015 The petitioner/applicant seeks a clarification in the judgment dated 9.9.2015 passed in W.P. (Crl.) 446/2015.
It has been submitted that certain observations made in para 17 and 22 of the judgment could have some impact on the case of the petitioner/applicant at the trial.
It is, therefore, requested that it be clarified that the observations made in the judgment are only for the purposes of deciding the issue of
joinder of trial and that such observations should not adversely impact the case of the petitioner on merits, at the trial. It goes without saying that such orders do not have any bearing on the merits of the case when it is wrested at the trial. However, it is clarified that the observations made in para 17 and 22 are only for the purposes of upholding the order of the Trial Court that the case of the petitioner is required to be tried along with the other accused persons but such observations have been made for the limited purpose as aforesaid. The application is disposed of.
