The Petition under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023, has been filed on behalf of the Petitioners, for quashing of the FIR bearing No. 94/2013 dated 28.02.2013 under Sections 308/323/506/34 IPC, registered at Police Station Bindapur, New Delhi, in terms of the Settlement dated 05.12.2024.

Briefly stated, on 27.02.2013 due to some monetary transaction, heated arguments and an altercation had taken place between the parties, wherein the Respondent No.2 and 3 suffered injuries and an FIR No.94/2013 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
was registered on 28.02.2013 at Police Station Bindapur, against the Petitioners herein.

It is submitted that the parties were known to each other and the altercation took place as the Complainant had to take some money from the Petitioners. It is further submitted that both the petitioners and respondent No. 2 have already sorted out their all differences with the intervention of their respective persons of the vicinity and they have left no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed.

The Complainant is present in the Court and submits that the matter stands settled with all the Petitioners and he has no objection if the FIR is quashed against the petitioners on account of the Settlement dated 05.12.2024, arrived at between the parties.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 8.
The learned APP for State has opposed the quashing of the FIR on the ground of previous involvement of Petitioner No.1, 2 and 4. 9.
Submissions heard.

The parties were known to each other and an altercation had taken place on account of Rs.1.15 lakhs which the Complainant had to take, which has now been paid by the Petitioners. Considering the nature of the dispute and the relationship, the Petition is allowed. 11.
Accordingly, the FIR bearing No. 94/2013 registered at Police Station Bindapur, for offences punishable under Sections 308/323/506/34 of the Indian Penal Code, 1860 with all the subsequent proceedings and the charge sheet is hereby quashed qua all the Petitioners.
