% 28.02.2019 The petitioner is aggrieved that despite lapse of more than four years, the prosecution's evidence has not been completed till date. He submits that there is hardly any precipitative step since July, 2018. Mr. Rajat Katyal, the learned Additional Public Prosecutor for the State submits that adjournments, if any, have been sought on behalf of the petitioner, therefore, he cannot allude any delay on the part of the prosecution. However, this argument is refuted by the learned counsel for the petitioner.
Be that as it may, the learned Additional Public Prosecutor for the State assures the Court that every endeavour shall be made to complete the recording of the prosecution's evidence within two months from today. All public witnesses have been examined. The remaining witnesses are government officials or police official, over whom the petitioner can have
no sway. The next date before the Trial Court for recording of evidence is 23.03.2019. The respondent shall move an application for preponement of the said date and having the evidence recorded by the end of April. Looking into long pendency of the case, the parties would request the Trial Court to dispose-off the case within four months from today. The learned counsel for the parties submit that they will assist the learned Trial Court in disposing-off the matter expeditiously and no adjournment shall be sought by them.
In view of the above, the learned counsel for the petitioner does not press the petition.
The petition stands dismissed as withdrawn. Liberty granted. A copy of this order be given dasti to the parties under the signature of the Court Master.
