CORAM:

% 17.05.2018 State has verified that petitioner's wife is in family way and her date of delivery is around 23rd May, 2018. In my view, presence of petitioner is required at the time of delivery.

Learned APP, who is assisted by the counsel for the complainant, has opposed the grant of interim bail.

She contends that petitioner was earlier granted bail which was cancelled by this Court. Petitioner preferred SLP against cancellation of his bail which was dismissed by the Supreme Court. In my view, this will not be a ground to decline the interim bail on the ground of exigency like present one. Accordingly, it is ordered that petitioner be released from jail on interim bail for a period of three weeks from the date of his release, subject to his furnishing a personal bond in the

sum of `25,000/- with one surety in the like amount to the satisfaction of the trial court. Petitioner shall, however, report to SHO of the concerned police station once in a week, that is, on Tuesdays at 10 am. After completion of interim bail petitioner shall surrender before the Jail Superintendent. Bail application is disposed of in the above terms. Dasti.
