This execution petition was filed as far back as in the year 2009 for execution of the ex parte judgment and decree dated 24th November, 2005 decreeing a sum of Rs.13,46,103/- along with interest at 12% per annum on Rs.8,17,500/- from 25th March, 1999 to 30th June, 2002 and on Rs.5,28,603/- from October, 2001 to 30th June, 2002, and for future interest at the rate of 9% per annum and proportionate costs.

The counsel for the decree-holder today states that both judgment-debtors no.1 and 3 i.e. Ashwani Kumar Chaddha and BTS Container Service Inc., Portland are situated outside India and have no assets in India. He further states that he has for the last several years been exploring the possibility of having warrants of arrest of judgment-debtor no.1 issued for execution at Portland where the judgment-debtor no.1 is residing but has not been able to come up with anything.

In this view of the matter, no purpose will be served in keeping this execution pending.

The execution petition is closed.
