The present application has been moved by the petitioner for the grant of regular bail in FIR No.93/2016, under Section 420 IPC, Police Station Lajpat Nagar.
As per FIR, the allegations levelled against the petitioner are that co-accused Varun Aggarwal had approached Range Teleservices to buy I-phone on finance and submitted forged documents for availing finance facility. During investigation, one of the distributors stated that he had purchased the mobile phone from the petitioner. He identified the photograph of the petitioner on the loan application form.
A raid was conducted and the petitioner was apprehended. Investigation further revealed that the cheque given by the petitioner at the time of taking loan was maintained in the name of Varun
Agarwal but the account was opened on the document having photograph of the petitioner.
During the course of arguments, learned APP for the State has stated that out of five mobile phones which were financed, three mobile phones have been recovered and two are yet to be recovered. However, it has been submitted that the same are not to be recovered from the petitioner but from the other co-accused. In the facts and circumstances, the application is allowed. It is hereby ordered that the petitioner be released on furnishing the personal bond in the sum of Rs.25,000/- with two sureties in the like amount to the satisfaction of the concerned learned MM. However, the petitioner is directed to join the investigation as and when required. He is directed not tamper with the evidence and shall not leave the country without prior permission of the Court concerned. The application is disposed of accordingly.
