The petitioner seeks regular bail in connection with FIR 490/2022 dated 12.09.2022 registered at police station Subzi Mandi under Sections 302/307 of the Indian Penal Code, 1860 and Section 25/27 of the Arms Act, 1959.

Ms. Manjeet Arya, learned Additional Public Prosecutor for the State, submits that material prosecution witnesses, including two eyewitnesses are yet to be in examined. 3.

It is the contention of Ms. Manisha Parmar, learned counsel for the petitioner, that the material witnesses have not appeared on several occasions, despite summons. Ms. Parmar therefore, seeks permission to approach the Sessions Court at the appropriate stage. submits that the petitioner may be permitted to renew his application for bail before the Sessions Court at that stage also. 4.

Ms. Arya submits that the prosecution will make every effort to ensure that the evidence of the eye-witness and other material witnesses is recorded as expeditiously as possible.

Having regard to these submissions, the petition is dismissed as withdrawn, without prejudice to the petitioner's right to renew his application before the Sessions Court at the appropriate stage. 6.

It is made clear that, if the said witnesses continue not to appear before the Court, and this causes inordinate delay in trial, it will be open to the petitioner to approach the Sessions Court on this ground. 7.

The petition is disposed of in these terms.

It is clarified that this Court has not made any observations on the merits of the matter, and all rights and contentions of the parties in any future application are left open.
