Petitioner/plaintiff has assailed order dated 27.11.2025, whereby its application seeking recall of order dated 09.10.2025 was dismissed by the learned trial court, going by the earlier order of this Court. The order dated 09.10.2025, whereby right of petitioner/plaintiff to lead evidence was closed, has not been challenged. Besides, it appears that in the earlier proceedings, this Court had granted only one opportunity to the petitioner/plaintiff to lead evidence, but the petitioner/plaintiff opted not to avail that opportunity, so right to lead evidence was closed on 09.10.2025 and application seeking setting aside of that order was dismissed by way of the impugned order.

After addressing partly, learned counsel for petitioner, on instructions of his client, seeks permission to withdraw this petition. 3.

As requested, the petition and the accompanying applications are dismissed as withdrawn.
