The petitioner has filed the present petition challenging the proceedings in a complaint case No. 47/01/2009 filed by the Respondent No. 2 under Section 500/506 of the Indian Penal Code, 1860.

It is pointed out that the complainant / Respondent No. 2 has already expired.

The learned counsel for the petitioner submits that in such circumstances, the complaint will not proceed and will stand abated. He seeks liberty to withdraw the present petition as having become infructuous.

In view of the above, the present petition is disposed of as having become infructuous.
