% 06.03.2019 CM APPL No.21493/2018 This application is moved by the respondent for directions to the petitioner to pay user/occupation charges in respect of subject premises per market rate. The respondent has claimed market rental to be Rs.25,000/- and has filed the copies of four lease deeds for the years ranging from 2016-17 wherein the rental ranges from Rs.10,000/- p.m.to Rs.14,000/- p.m. and such premises are situated at the first and second floor; whereas the premises in question is on the ground floor and area is almost similar. The learned counsel for the petitioner disputes the quantification of rental, however has nothing to refute the lease deeds.

In the circumstances as an interim measure the petitioner is directed to pay to the respondent an amount of Rs.10,000/- per month w.e.f. 01.08.2018 till the pendency of this petition as user/occupation

charges. The arrears be cleared by four weeks and future payment be made on or before 7th of each calendar month. The water and electricity charges be paid as per actuals. Any default in the payment of user/occupation charges shall entail eviction forthwith. The application stands disposed of in terms of above. Order dasti to both the parties.
