% 21.04.2016 CM No. 13955/2016 (u/O 6 R 17 CPC) &WP(C) No.2635/2016 By this application, petitioner seeks to amend the petition thereby adding the ground of challenge to the vires of Section 170(b) of the DMC Act, 1957 as being violative of Article 14 of the Constitution. Learned senior counsel for the respondent submits that such a challenge can be laid before the Division Bench. At this stage, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file a fresh petition by taking all the grounds as may be available to the petitioner. Leave and liberty granted. Writ petition is disposed of as withdrawn. Interim order

dated 4th April, 2016 shall remain in force for 10 days only, in order to enable the petitioner to file a fresh writ petition. Miscellaneous applications are disposed of as infructuous.
