% 05.04.2018 Ex.Appl.(OS) No.101/2018 It is submitted by learned counsel for the decree holders that on 04.01.2016 this Court has passed decree of permanent injunction against the plaintiffs. The judgment debtors were to pay 1 crore to the decree holders and accordingly notice was sent to the judgment debtors to pay the said amount but they failed and as such this execution petition was filed praying for direction to pay the damages of 1 crore and the cost of the proceedings as incurred by the plaintiffs during the pendency of the suit along with interest @ 6% as awarded. The said execution petition was disposed of by transferring decree to concerned District Court, Chandigarh as judgment debtors reside at Chandigarh. It was directed so vide order dated 22.03.2017. However, there was a delay in collecting and filing the transferred execution petition from this Court's registry hence, the files had
been transferred back to the registry of this Court. It is submitted that the delay was neither intentional nor malafide. In the circumstances, the registry of this Court is directed to transfer the files viz., the transfer certificate, the complete petition copy and all other relevant documents to the concerned District Court, Chandigarh in compliance with the order dated 22.03.2017 to enable the decree holder to apply for the execution before the concerned court.
The application stands disposed of.
