% 12.12.2018 On the complaint of the petitioner FIR No. 84/2008 under Sections 420/467/468/471 read with Section 120B IPC was registered at PS EOW. Grievance of the petitioner is that despite the fact charge was framed on 7th June, 2011 till date trial has not concluded. This Court on receipt of the status report from the State called for a report from the learned Trial Court seeking reasons for delay in the trial. A report has been received from the learned Trial Court who has now expedited the trial and entire prosecution evidence has been recorded by 11th September, 2018. However, in the report learned ACMM North-West Rohini Court has also noted "the petitioner/complainant has moved the application before the Hon'ble High Court of Delhi to overawe and put W.P.(CRL) 1066/2018
pressure upon this Court as the said request has not been made by the applicant/complainant Prem Prakash Chauhan before the undersigned on any date".
This observation of the learned ACMM is totally uncalled for. Taking remedies by any of the parties before a forum is a right conferred on the party and cannot be treated by a Judge as a measure of overawing the Court. The learned ACMM will be careful in making such observations in future. Copy of this order be communicated to the Committee of the inspecting Judges for counselling of the learned ACMM.
Since prosecution evidence has been concluded no further orders are called for in the present petition.
Petition is disposed of.
