Learned counsel for the petitioner submits that since this revision petition impugning the order dated 28.05.2013 passed in Crl.A. No.126/2011, is not maintainable, he may be permitted to withdraw the present petition with liberty to avail the appropriate remedy available under the law and seek condonation of delay as he filed this revision petition under the bonafide belief that it is maintainable.

Accordingly, the revision petition is dismissed as withdrawn granting the liberty as prayed for.
