The present petition has been filed by the petitioner under Section 528 BNSS /Section 482 Cr.P.C.) seeking quashing of FIR No. 41/2023 under Sections 289/337 IPC registered at P.S. Vikas Puri and all consequential proceedings emanating therefrom, on the ground that the parties have arrived at a settlement.

Petitioner as well as respondent no.2 are present in Court. They have been identified by Mr. Sanjay Suri, learned counsel for the petitioner, as well as, by Investigating Officer IO/SI Ramdhan, PS-Vikas Puri. 6.

The case of the prosecution is that the above FIR was registered on the allegation that the complainant/respondent no.2 was bitten by the dog of the petitioner.

During pendency of the proceedings the parties have already compounded offence under Section 337 IPC. However, the present petition has been filed since the other offence invoked under Section 287 IPC is noncompoundable. The terms of settlement have been reduced in writing in the form of memorandum of understanding dated 21.08.2024, copy of which is annexed as Annexure-C to the present petition. 8.

In terms of the said settlement, the petitioner agreed to compensate respondent no.2 by making full and final settlement amount of Rs.20,000/-. The said amount is stated to have been paid and the respondent no.2 who is present in the Court affirms the factum of settlement and acknowledges receipt of settlement amount of Rs.20,000/-.

Respondent no.2, on a query posed by the Court, states that she does not wish to prosecute criminal proceedings any further and has no objection in case the FIR is quashed.

In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, rather the same would create further acrimony between them.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 12.

Consequently, the petition is allowed and the FIR No. 41/2023 under The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Sections 289/337 IPC registered at P.S. Vikas Puri alongwith all other proceedings emanating therefrom, is quashed.

The petition stands disposed of in the above terms. 14.
