versus BHAGAT AROMATICS LTD. & ANR ..... Respondents Through :

Mr. Sanjay Lao, ASC with ASI Jai Bhagwan PS Pandav Nagar for R-2.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 02.11.2016 Petitioner no.9 is sister concern of petitioner no.1. Petitioner nos.2 to 5 are the directors. Petitioner nos.6 to 8 are the employees of the aforesaid firms. Petitioner nos.1 & 9 used to supply certain goods to respondent no.1 from time to time.

Respondent no.1 alleged that goods supplied were of inferior quality. On the complaint of respondent no.1, FIR No.96/2013 under Sections 120B/420/467/468/471/500 IPC was registered at police station Pandav Nagar.

Petitioners and respondent no.1 have now settled their disputes vide deed of compromise dated 8th November, 2013. Mr. Dilip Chakraborty, authorized representative of respondent no.1 is present in Court and admits that matter has been settled between respondent no.1 and

petitioners without any undue force, coercion and influence. He further submits that the entire settled amount has been paid by the petitioners to respondent no.1. He further submits that respondent no.1 has no objection, in case FIR is quashed.

Keeping in mind the fact that dispute is basically with respect to a commercial transaction and parties have settled the same, I am of the opinion that no fruitful purpose would be served to keep the criminal proceedings pending.

Accordingly, FIR No.96/2013 under Sections 120B/420/467/468/471/500 IPC registered at police station Pandav Nagar, which is at the investigation stage, is quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
