O R D E R

% 28.03.2016 The present petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (CrPC), prays as follows:- "Under these circumstances, it is, therefore, prayed that this Hon'ble Court may graciously be pleased to pass necessary directions/orders to the concerned police authorities as well as respondent no. 1 and 2 to take appropriate action against the respondent No.3 and to protect the life of the Petitioners as per fundamental rights of the constitution of India, in the nature of mandamus for the interest of justice."

At the outset it is noticed that it is an admitted position that petitioner No.1 Rukshana @ Ritika is currently lodged at the Nari Niketan and that petitioner No.2 Deepak is in judicial custody. It is further noticed that the petitioner No.1 shall be produced before the Magistrate concerned for recording of her statement under Section 164 CrPC by the IO in FIR No.330/2016 under

Section 363/366/376 IPC and Section 12 of the POCSO Act registered at Police Station- Aman Vihar, post-lunch today.

In view of the foregoing the present petition seeking protection has been rendered infructuous and is disposed of accordingly. SIDDHARTH MRIDUL, J MARCH 28, 2016 mk
