This is a petition filed under Section 29A(5) of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the Arbitral Tribunal by a further period of 1 year for making and publishing the final Award.

It is stated that the position of Special Secretary remained vacant and there was no Arbitrator available to conduct the pending proceedings and hence, the delay.

For the said reasons, issue notice to the respondents. 4.
Mr. Jetly, learned CGSC and Ms. Sharma, learned counsel accept notice on behalf of the Union of India (UoI) and National Highways Authority of India (NHAI) respectively and has no objection to the petition being allowed.
5. I am satisfied that sufficient cause has been shown for the delay. In view of the aforesaid, the mandate of the Arbitral Tribunal is extended by a further period of 1 year from today to conclude the arbitration proceedings.
