CRL.M.C. 1842/2018 1.
Petitioner seeks quashing of FIR No.309/2014, under Sections 452/323/506 IPC, Police Station Badarpur, Delhi, based on a Settlement.
2.
Parties have amicably settled their disputes. Settlement was arrived at before the Mediation Centre, Saket Courts, New Delhi, on 09.03.2018.
3.
Respondent No.2 is present in Court in person and is identified by the Investigating Officer. He confirms that a Settlement has been arrived at between the parties and further submits that he does not Crl.M.C.1842/2018
wish to press his complaint any further.
4.
In view of the above and keeping in view of the fact that the parties have resolved their dispute before the Mediation Centre, Saket Courts, New Delhi, on 09.03.2018 and further respondent No.2 does not wish to press his complaint, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.
5.
Accordingly, FIR No.309/2014, under Sections 452/323/506 IPC, Police Station Badarpur, Delhi, and the consequent proceedings emanating therefrom are hereby quashed, subject to the petitioner depositing costs of Rs.5,000/-, which shall be paid to the "Prisoners Welfare Fund, Jail No. 13, Mandoli", Mangal Pandey Marg, Harsh Vihar, Village Mandoli, Delhi, within a period of two weeks from today. Receipt of deposit of the costs imposed by this Order be furnished to the concerned Investigating Officer within a period of three weeks from today.
