The instant petition under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 (hereinafter "BNSS") has been filed by the petitioner praying for quashing of FIR 220/2017 registered at Police Station Badarpur on 07.06.2017, for offences punishable under Sections 279/323/341/506/34 of the Indian Penal Code, 1860 (hereinafter "IPC"). 2.

The petitioners are present before this Court and have been identified by their counsel Mr. Faheem Alam and Investigating Officer, Police Station Badarpur. Respondent 3 is also present in the Court and has been identified by her counsel and the Investigating Officer. 3.

On a query made by this Court, Respondent 3 has categorically stated that he has entered into compromise on his own free will and without any pressure. The brief facts of the case are that the Respondent 3 is the resident of H.No. 235, Village Ghusrana Gail, Parchayain Mohalla, P.D Dibai, District Bulandshahar, UP. He is employed as a bus driver. On 07.06.2017, while on duty, it was alleged that the accused, travelling in a car, collided with the bus from behind. Thereafter, a heated argument broke out, and Respondent 3 was allegedly assaulted by the three passengers travelling in the car. 5.

Learned counsel appearing on behalf of the petitioners submitted that charges have been framed and the chargesheet has already been filed against the petitioners. It is submitted that the petitioners and Respondent 3 have settled their disputes amicably and are now moving forward towards a peaceful and harmonious future. It is further submitted that Respondent 3 has been duly compensated for the injuries suffered by him along with his medical expenses by the petitioners.

Compromise deed dated 12.01.2024 is on record and has been annexed as Annexure P-3. Qua this deed, Respondent 3 has agreed to withdraw the case arising out of FIR 220/2017 registered at Police Station Badarpur against the petitioners.

It is prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the compromise. 8.

Mr. Raghuvendra Verma, learned APP for the State submitted that there is no opposition to the prayer made by the petitioners seeking quashing of the FIR in question in view of the settlement arrived at between the parties.

Keeping in view the fact that the matter stands amicably been settled between the petitioners and Respondent 3 amicably without any pressure, no fruitful purpose would be served by keeping the matter pending. 11.

Hence, in light of the judgment of the Hon'ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303, FIR 220/2017 registered at Police Station Badarpur, for offences punishable under Sections 279/323/341/506/34 of the IPC, and consequent proceedings emanating therefrom, are quashed subject to payment of cost of Rs.10,000/-, which shall be deposited with the 'CDCBA Members Welfare Fund Account' bearing A/c No.33640110020388 (IFSC Code: UCBA0003364) maintained with the UCO Bank, Rouse Avenue Court Complex, New Delhi within a period of one week from today. The receipt of payment is to be deposited with and to be verified by the concerned IO.

The petition along with pending applications, if any, stands disposed of.
