This application has been filed on behalf of the applicant/ petitioner seeking revival of the present writ petition as the respondents have failed to take action in terms of the order passed by this Court on 23rd December, 2025 disposing of the writ petition.

Counsel appearing on behalf of the respondent no.1/ MCD on instructions, submits that after the writ petition was disposed of, a demolition order was passed on 12th January, 2026 and subsequently, an application for regularization was filed on behalf of respondent no.2. The MCD issued an order directing respondent no.2 to carry out certain rectifications on 11th February, 2026. However, the same has not been done. action has now been fixed for 29th April, 2026. 3.
In view thereof, the present application is disposed of while directing respondent no.1/ MCD to carry out the proposed demolition action fixed for 29th April, 2026. The concerned SHO shall provide the necessary police force for the proposed demolition action.

In the event, the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

All rights, contentions and legal remedies of the private respondent no.2 are kept open.
