The application stands disposed of.

The present petition has been filed by the petitioners stated to be belonging to the EWS category, praying as under: "A. Issue a writ, order or direction rn the nature of mandamus or any other appropriate writ thereby directing the respondent no. l to provide medical aid by directing the respondent no.2 to give free treatment to the petitioners namely Mr. Imran Malik, Mrs. Shagufta Malik and Mst. Subhari Malik, who belong to economical weaker section and holding EWS card issued by Delhi Government.;

B. Issue a ·writ, order or direction in the nature of mandamus or any other appropriate writ thereby directing the respondent no. l to take coercive action against the respondent no.2, hospital for refusal to give treatment to the patient namely Mr. Imran Malik, Shagufta Malik and Mst. Subhan Malik being the EWS category. C. aforesaid facts and circumstances may also be passed in favour of the Appellant and against the Respondent." 4.

Learned counsel for the respondent no.2 while strongly refuting the allegations made in the writ petition submits that the requisite treatment has been provided to the petitioners under EWS category at the respondent no.2/ Primus Super Speciality Hospital. The said statement is taken on record. 5.

In support of the said contention, attention is also drawn to the medical documents/ invoices filed as Annexure P-5 and P-7 along with the present petition.

In the circumstances, no further orders are required to be passed in the present petition except to take note of the aforesaid contention of learned counsel for the respondent no.2. Let requisite treatment continue to be provided to the petitioners by the respondent no.2, including, by ensuring adequate provision/s for medicine, conduct of test/s, in accordance with the relevant rules and regulations.

Needless to say, the aforesaid shall be subject to the petitioners being eligible under the relevant rules to avail treatment under the EWS category. 8.
